Terms of Service

1. Agreement and eligibility

These Terms of Service (“Terms”) are a legal agreement between you and FluxHoster (“FluxHoster,” “we,” “us,” or “our”) governing your access to and use of FluxHoster’s websites, account dashboard, website creation and management tools, hosting-related services, domain services, support, and related features (collectively, the “Service”).

By creating an account, purchasing a plan, submitting an order, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you use the Service for a company or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

You must be at least 18 years old, or the age of legal majority where you live, and legally capable of entering a binding contract. The Service is not intended for children.

2. Service and accounts

2.1 What FluxHoster provides

Depending on your plan and configuration, the Service may include website design or development assistance, templates, editing tools, project briefs, managed deployment or hosting, custom-domain connection, DNS management, registrar services, traffic or performance information, and customer support. Features and limits shown on the pricing page, order screen, or an agreed order form are part of these Terms.

2.2 Your account

You must provide accurate information and keep it current. You are responsible for safeguarding your password, recovery phrase, and other credentials; for restricting access to your account; and for activity performed through your account. Do not share a recovery phrase or domain transfer authorization code with anyone who is not authorized to act for you.

Tell us promptly at [email protected] if you suspect unauthorized access. We may require reasonable verification before changing account, billing, website, or domain settings.

2.3 Account communications

You agree that we may send transactional communications needed to operate the Service, including security notices, receipts, subscription and renewal notices, domain verification or transfer messages, service announcements, and support responses. Keep your email address current so you do not miss time-sensitive domain or billing messages.

3. Plans, billing, automatic renewal, and cancellation

3.1 Plans and prices

FluxHoster may offer Basic, Pro, Enterprise, monthly, annual, promotional, trial, or custom arrangements. The features, billing period, price, taxes, and any additional fees displayed at checkout or in an order form control your purchase. Enterprise or custom work may be subject to a separate written order form or statement of work.

3.2 Payment processing

Stripe processes payment-card transactions for us. You authorize FluxHoster and Stripe to charge your selected payment method for the amounts presented at checkout, including recurring charges, taxes, and approved add-ons. FluxHoster does not receive or store your complete payment-card number or security code.

3.3 Consent, notices, and price changes

Before purchase, we will present the material automatic-renewal terms and request your affirmative consent. After purchase, we will provide a confirmation that you can retain. We will send renewal reminders, trial or promotional notices, and notices of material price or plan changes where and when required by applicable law. If a change does not take effect until renewal, you may cancel before that renewal.

3.4 How to cancel

You may cancel online through the FluxHoster dashboard or the Stripe-hosted billing portal. If you cannot access those tools, email [email protected] from the address associated with your account. We may authenticate the request to protect your account, but we will not require unnecessary steps that obstruct cancellation.

Unless stated otherwise at purchase, cancellation stops future renewal and becomes effective at the end of the current paid billing period. You will retain plan access through that date unless the Service is suspended under these Terms. Deleting a website or stopping use does not by itself cancel a subscription.

3.5 Refunds

Except where required by law or expressly stated in the applicable order, fees are nonrefundable and we do not provide credits for a partially used billing period. Domain registration, renewal, restoration, registry, and other third-party charges are nonrefundable once submitted to the provider because they generally cannot be reversed. Nothing in this section limits any mandatory cancellation or refund right.

3.6 Failed payments and taxes

If a charge fails, we or Stripe may retry the payment, ask you to update your method, or limit paid features. You remain responsible for accrued charges and applicable taxes, other than taxes measured by our net income. We will not state or guarantee a fixed retry schedule unless it is shown to you for that transaction.

4. Domain registration, renewal, and transfer services

FluxHoster facilitates certain domain services through third-party registrars, currently including DNSimple, and may use Cloudflare for DNS, security, or content delivery. FluxHoster is not an ICANN-accredited registrar. When we act as a reseller or technical agent, the registrar remains the registrar of record and its registration agreement, registry rules, ICANN policies, and applicable law also apply.

4.1 Registrant information and authority

You must provide complete, accurate, and current registrant and administrative contact information, including your legal name, address, email, and telephone number. You represent that you are the registrant or are authorized to act for the registrant. You authorize us to send the information needed to the registrar, registry operator, ICANN-related providers, and DNS providers to process your request.

Failure to verify or maintain accurate registration data may cause a registration or transfer to fail or a domain to be suspended, canceled, locked, or otherwise affected under registrar, registry, or ICANN rules. Privacy or proxy registration may be enabled where available, but it is not available for every top-level domain and does not eliminate lawful disclosure obligations.

4.2 Availability and successful registration

A search result is not a reservation or guarantee. A domain may become unavailable before registration completes, may be restricted or premium-priced, or may be rejected by the registrar or registry. Your registration is complete only when the registrar confirms it. You are responsible for checking the spelling, top-level domain, registrant details, and price before submission.

4.3 Included-domain benefits

A plan may include one eligible domain registration while the subscription remains active. Unless the offer states otherwise, eligibility is limited to supported, standard-priced top-level domains; premium, aftermarket, restoration, redemption, brokerage, or unusual registry fees are excluded. The pricing page and checkout disclosure in effect when you purchase describe the current benefit.

An included domain is not “free forever” independent of the subscription. Before canceling or allowing a plan to lapse, review the domain’s expiration, renewal, DNS, and transfer status. Charges required to keep, renew, restore, or transfer a domain after the included benefit ends may apply and will be shown when available.

4.4 Transfers into FluxHoster

To transfer a domain, you may need to unlock it, obtain an AuthInfo/EPP code, verify registrant contact information, approve confirmation emails, and pay or authorize any required renewal. You authorize us to transmit the transfer credential to the gaining registrar solely to process the transfer. Treat this code as a password.

Transfers can be delayed or denied for reasons outside our control, including recent registration or transfer locks, registrant changes, disputes, court orders, fraud concerns, unpaid fees, expiration status, unsupported top-level domains, incorrect authorization codes, or failure to approve required messages. DNS and website service may continue at the former provider until the transfer completes.

4.5 Renewal, expiration, and restoration

Domains may be configured for automatic renewal, but renewal is not guaranteed. A renewal can fail because of payment problems, outdated contact information, registry action, provider error, or other circumstances. You remain responsible for monitoring expiration dates and keeping payment and contact information current. Expired domains may stop resolving, enter redemption, incur restoration fees, or become available to others.

4.6 Transfer out, locks, and ownership disputes

Subject to applicable registrar, registry, and ICANN rules, an authorized registrant may request that a domain be unlocked and obtain the information needed to transfer it to another provider. Required waiting periods, identity checks, dispute holds, or transfer locks may apply. We may decline instructions from someone who cannot establish authority over the account or registration.

FluxHoster does not decide private ownership, trademark, or registrant disputes. We may follow instructions from the registrar or registry, an applicable ICANN dispute process, a court, or another legally authorized body. You are responsible for ensuring that your registration and use do not infringe another person’s rights.

4.7 DNS changes and propagation

DNS updates may take time to propagate and can be affected by caching, nameserver configuration, registry systems, and third-party outages. We do not guarantee an exact activation or propagation time. You are responsible for reviewing records before replacing existing DNS, especially records used for email or other critical services.

5. Your content and intellectual property

5.1 Ownership

As between you and FluxHoster, you retain ownership of content you submit, upload, create, or direct us to use, including text, images, logos, code, business information, and project materials (“Customer Content”). FluxHoster and its licensors retain ownership of the Service, software, interfaces, templates, documentation, branding, and other materials we provide, excluding Customer Content.

5.2 License needed to provide the Service

You grant FluxHoster a worldwide, nonexclusive, royalty-free license to host, copy, modify, process, transmit, display, and otherwise use Customer Content only as reasonably necessary to provide, secure, support, improve, or comply with law in connection with the Service. This license lasts while the content is stored or used for your account, plus a limited period for backups, legal compliance, and orderly deletion.

5.3 Your promises about content

You represent that you have all rights and permissions needed for Customer Content and our permitted use of it; that the content and your website comply with law and these Terms; and that you will obtain any notices, consents, and licenses required for personal information, images, trademarks, copyrighted works, and third-party code you provide.

5.4 Feedback

If you voluntarily send ideas or feedback about the Service, you grant us a perpetual, worldwide, nonexclusive, royalty-free right to use that feedback without restriction or compensation, provided we do not identify you publicly without permission.

6. Acceptable use

You may not use the Service to:

• violate law, regulation, court order, or the rights of another person;
• host or distribute malware, credential theft, phishing, scams, or deceptive impersonation;
• gain unauthorized access to accounts, systems, data, or networks, or interfere with their operation;
• send spam or unsolicited bulk communications, or facilitate abusive traffic;
• upload content that is unlawful, infringing, exploitative, or that depicts or facilitates child sexual abuse;
• publish another person’s highly sensitive information without lawful authority;
• evade rate limits, security controls, content review, account restrictions, or provider policies;
• resell or provide access to the Service except as expressly permitted in writing;
• use excessive resources in a way that materially degrades the Service for others; or
• use a domain or website in a way that violates applicable registrar, registry, hosting, or network rules.

We may use automated tools and human review to identify spam, malware, abusive files, or other policy violations. Automated review is not perfect and does not make FluxHoster responsible for Customer Content. We may remove or restrict content when reasonably necessary to protect users, providers, or the Service; comply with law; or enforce these Terms. Where appropriate, we will provide notice and a reasonable opportunity to respond.

7. Your website and visitor responsibilities

You control the purpose and content of your website. You are responsible for:

• the accuracy, legality, accessibility, and operation of your website and offers;
• publishing privacy notices, cookie choices, terms, and other disclosures required for your visitors;
• obtaining consent before collecting or using visitor information when required;
• responding to visitor, consumer, or data-subject requests for information you control;
• configuring domains, email, forms, analytics, integrations, and access permissions appropriately;
• maintaining independent copies of critical content and data; and
• complying with advertising, ecommerce, tax, consumer-protection, accessibility, and industry-specific laws that apply to your website.

When FluxHoster processes personal information for you through a customer website, you are generally the business or controller that determines why the information is processed, and FluxHoster acts as your service provider or processor to the extent required by applicable law.

8. Third-party services and integrations

The Service depends on third parties and may connect to services such as Stripe, DNSimple, Cloudflare, Turso/libSQL, GitHub, and AWS. Your use of a third-party feature may also be governed by that provider’s terms and privacy notice. You authorize us to exchange information with those providers as reasonably necessary to provide your requested feature.

We do not control third-party systems, policies, pricing, outages, or decisions. We are not responsible for a third party’s service except to the extent the law does not permit that responsibility to be excluded. We may replace a provider or integration with a reasonably comparable service.

9. Service changes, availability, and support

We may add, change, limit, or discontinue features as the Service evolves. If a change materially reduces a paid plan during its current term, we will provide reasonable notice when practicable and any remedy required by law or an applicable order form.

We work to keep the Service available, but maintenance, security events, internet failures, domain or DNS propagation, provider outages, and other events can interrupt it. Unless an order form includes a separate service-level agreement, availability statements are targets, not guaranteed service levels. Support response estimates are not guarantees.

Beta, preview, or experimental features may be incomplete, change without notice, and have additional limitations. Use them at your own risk and do not rely on them for critical operations.

10. Suspension, termination, and data access

10.1 By you

You may stop using the Service at any time and cancel a paid subscription as described in Section 3. Account deletion and subscription cancellation are separate actions. Before deleting an account, export content you want to keep and review the status of domains, DNS, and third-party integrations.

10.2 By FluxHoster

We may suspend or limit the Service if reasonably necessary to address a security threat, unlawful or abusive activity, nonpayment, material breach, provider requirement, or risk of harm. We may terminate your account for a material breach that is not cured after reasonable notice, unless immediate action is reasonably necessary or the breach cannot be cured.

10.3 Effect of termination

When access ends, your right to use the Service stops. We may preserve limited access or a reasonable export window when practicable, but we do not guarantee recovery after deletion or provider removal. We may retain information where required for billing, fraud prevention, dispute resolution, legal compliance, backups, or other legitimate purposes described in the Privacy Policy.

Termination does not automatically override registrar or registry rights and obligations for a domain. You remain responsible for completing any permitted transfer, renewal, or DNS change before relevant deadlines.

11. Privacy and confidentiality

Our Privacy Policy explains how FluxHoster handles personal information. Each party may receive nonpublic information that is identified as confidential or should reasonably be understood to be confidential. The receiving party will use reasonable care to protect it and use it only for the relationship, except when disclosure is authorized, required by law, or made to personnel or service providers who need it and are subject to appropriate duties.

Confidential information does not include information that becomes public without breach, was already lawfully known, is received lawfully without restriction, or is independently developed without use of the other party’s confidential information.

12. Disclaimers

We do not warrant that the Service will be uninterrupted, error-free, or completely secure; that a domain will be available, transfer successfully, or renew; that content or data will never be lost; or that a website will achieve particular traffic, revenue, search ranking, accessibility, legal compliance, or performance results.

FluxHoster does not provide legal, tax, accounting, trademark-clearance, or other professional advice. Templates, generated materials, accessibility tools, analytics, and policy examples require your independent review. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

13. Limitation of liability

To the maximum extent permitted by law, neither FluxHoster nor its affiliates, personnel, or suppliers will be liable for indirect, incidental, special, exemplary, consequential, or punitive damages; loss of profits, revenue, business opportunity, goodwill, data, or domain use; or the cost of substitute services, even if advised that the loss was possible.

To the maximum extent permitted by law, the total aggregate liability of FluxHoster and its affiliates, personnel, and suppliers arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to FluxHoster for the Service during the 12 months before the event giving rise to the claim or (b) US $100.

These limitations apply regardless of the form of action and allocate risk between the parties. They do not limit liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable. Consumer rights that cannot be waived remain in effect.

14. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless FluxHoster and its affiliates, personnel, and suppliers from third-party claims, damages, penalties, and reasonable costs arising from: (a) Customer Content or your website; (b) your violation of law, these Terms, or another person’s rights; (c) your products, services, or dealings with website visitors; or (d) a domain registration or use you requested. We will provide reasonable notice and cooperation. You may not settle a claim in a way that admits fault by or imposes obligations on FluxHoster without our written consent.

15. Copyright and rights complaints

If you believe material hosted through the Service infringes your copyright or other rights, email [email protected] with the subject “Copyright Notice.” Include your contact information; identification of the protected work; the exact URL or location of the material; a good-faith statement explaining why the use is unauthorized; a statement that the notice is accurate and that you are authorized to act; and your physical or electronic signature.

We may forward a complaint to the affected customer or relevant provider. Knowingly making a material misrepresentation in a copyright notice or counter-notice may create liability. This contact process does not represent that FluxHoster has made any filing or designation with a government copyright office.

16. Governing law and disputes

Before filing a formal claim, you and FluxHoster agree to try in good faith for 30 days to resolve the issue by written notice to the other party. Send your notice to [email protected] with the subject “Legal Notice” and describe the issue and requested resolution.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to mandatory consumer law and any court with exclusive jurisdiction, disputes will be brought in the state or federal courts located in San Francisco County, California, and each party consents to those courts. Nothing here prevents either party from seeking urgent injunctive relief or using an eligible small-claims court.

If you are a consumer, you retain any rights and venue protections that cannot be waived under the law where you live.

17. Changes to these Terms

We may update these Terms to reflect changes in the Service, providers, law, security needs, or business practices. We will post the revised Terms and update the date above. If a change materially reduces your rights or increases your obligations, we will provide additional notice when required, such as by email or an in-product message.

Material changes apply prospectively from the stated effective date. Changes to an automatic-renewal price or material renewal term will be communicated with cancellation information as required by law. If you do not agree to revised Terms, you must stop using the Service and cancel before the change applies to your next renewal.

18. General terms and contact

These Terms, the Privacy Policy, the checkout disclosures, and any applicable order form are the entire agreement about the Service. If an order form expressly conflicts with these Terms, the order form controls for that order. You may not assign these Terms without our consent; we may assign them as part of a merger, financing, reorganization, sale, or transfer of the Service, subject to applicable law.

If a provision is unenforceable, it will be modified only as much as needed and the remainder will continue. A failure to enforce a provision is not a waiver. Headings and summaries are for convenience. “Including” means “including without limitation.” Sections that by their nature should survive—such as payment obligations, intellectual property, disclaimers, liability limits, indemnity, and dispute terms—survive termination.

Neither party is liable for delay caused by events beyond its reasonable control, except that this does not excuse payment obligations already due.
