1. Acceptance of Terms
By accessing or using the FluxHoster website building and hosting platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and FluxHoster LLC, a Delaware limited liability company ("FluxHoster," "we," "our," or "us").
2. Description of Service
FluxHoster provides a Software-as-a-Service (SaaS) platform that enables users to create, design, host, and manage websites through the following features:
Website Creation Tools: Pre-designed templates (brutalist, minimalist, modern, playful, restaurant) and a GrapesJS drag-and-drop visual editor for custom website design.
Brief Submission System: Users may submit project requirements for custom design requests, which are encrypted using AES-256-CBC.
Managed Hosting: Automated deployment to GitHub Pages, custom domain support via Cloudflare DNS, and global CDN delivery.
Subscription Service: Three-tier subscription plans (Basic, Pro, Business) with monthly or annual billing options.
Domain Services: Domain transfer management, DNS management, and EPP code retrieval.
Content Moderation: Mandatory image screening via AWS Rekognition and text moderation for all brief submissions.
Important: FluxHoster deploys websites to GitHub Pages using your GitHub account. Your use of GitHub is subject to GitHub's separate Terms of Service and Privacy Policy. FluxHoster is not responsible for GitHub's services or any content hosted on GitHub's platform.
3. User Eligibility
You must be at least 13 years of age to use the Service. If you are between 13 and 17 years of age, you represent that you have parental or guardian consent to use the Service. If you are under 13, you may not use the Service under any circumstances. By creating an account, you represent and warrant that you meet these eligibility requirements.
Users under 18 must have their parent or guardian review and consent to these Terms on their behalf. FluxHoster does not knowingly collect personal information from children under 13. If we discover that we have inadvertently collected information from a child under 13, we will promptly delete such information and terminate the account.
4. Account Registration and Security
4.1 Account Creation
To use the Service, you must register for an account by providing your email address, creating a password, and completing any required verification steps. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your password and any 12-word recovery phrase provided during registration. You agree to:
Use a strong, unique password that is not used for any other service.
Keep your recovery phrase in a secure, offline location.
Notify us immediately at [email protected] of any unauthorized access or breach of security.
Accept all responsibility for activities that occur under your account.
4.3 Session Management
FluxHoster uses cookie-based session authentication with the following measures:
Session cookies (fh_auth or __Host-fh_auth) with 30-day expiration.
HTTP-only, Secure, and SameSite attributes for all authentication cookies.
CSRF protection via double-submit cookie pattern.
Automatic session invalidation upon password change or security event.
Rate limiting of 15 requests per minute per IP address and per user account.
5. Subscriptions and Payments
5.1 Subscription Plans
Basic: 14.99 USD per month – Single website, basic templates, community support.
Pro: 24.99 USD per month – Multiple websites, advanced templates, custom domain support, priority support.
Business: Contact Sales – Unlimited websites, all templates, white-label options, dedicated support.
5.2 Billing and Payment Processing
All payments are processed by Stripe, Inc. ("Stripe"). By subscribing to the Service, you agree to Stripe's Terms of Service and Privacy Policy. FluxHoster does not store your payment card information. We store only:
Your billing email address.
Your subscription plan and status.
Payment history references from Stripe.
5.3 Automatic Renewal
All subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged the then-current subscription fee at the time of renewal. We will provide notice of any price changes at least 30 days in advance.
5.4 Cancellation and Refunds
No Refunds Policy: All subscription fees are non-refundable. When you cancel your subscription, your cancellation will take effect at the end of your current billing period, and you will not receive a refund for any unused portion of that period. This no-refund policy applies unless otherwise required by applicable law.
To cancel your subscription, you must do so through your account dashboard or by contacting support at [email protected]. Cancellations must be completed at least 24 hours before your renewal date to avoid being charged for the next billing period.
5.5 Failed Payments
If a payment fails, we will attempt to collect the payment up to three times over a seven-day period. During this time, your account may be temporarily suspended. If payment is not successfully collected within seven days, your account will be terminated, and your data may be deleted in accordance with our Data Retention policy.
5.6 Price Changes
We reserve the right to change our subscription prices at any time. We will provide you with at least 30 days’ notice before any price change takes effect. Your continued use of the Service after the price change constitutes your acceptance of the new price.
6. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct while using the Service and for any content you create, upload, or distribute through the Service.
6.1 User Responsibilities
You agree to:
Comply with all applicable laws, regulations, and third-party rights (including intellectual property rights).
Obtain all necessary licenses, permissions, and consents for your content.
Ensure your content does not violate the rights of any third party.
Use strong, unique passwords and safeguard your account credentials.
Maintain accurate and up-to-date account information.
Pay all applicable fees and taxes related to your use of the Service.
6.2 Prohibited Conduct
You may not:
Use the Service to impersonate any person or entity.
Engage in fraudulent, deceptive, or misleading practices.
Attempt to hack, exploit, or bypass any security measures.
Reverse engineer, decompile, or extract source code from the Service.
Use automated tools (including bots or scrapers) to access the Service without authorization.
Resell, redistribute, or sublicense the Service without written permission.
Harass, abuse, or threaten other users or FluxHoster personnel.
Overload or disrupt the Service’s infrastructure.
7. Prohibited Content and Activities
FluxHoster maintains a zero-tolerance policy for certain types of content. All user content is subject to mandatory screening before publication. The following content categories are strictly prohibited and will result in immediate account suspension or termination without prior notice.
7.1 Automatically Blocked Content Categories
Adult/Sexual Content: Pornography, explicit nudity, adult entertainment websites, escort services, sex work, or any sexual content involving people.
Gambling: Online casinos, gambling sites, betting platforms, sportsbooks, bookmakers, poker rooms, slot machines, or lottery sites.
Illegal Drugs: Drug marketplaces, cannabis delivery services (in jurisdictions where illegal), or sales of illegal substances.
Weapons: Firearms sales, weapon marketplaces, ammunition sales, or explosives.
Illegal Activities: Fraud, scams, phishing, hacking tools, malware distribution, piracy, copyright infringement, or identity theft.
Hate Speech: Content that promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics; hate group propaganda; or incitement to violence.
7.2 Content Moderation Enforcement
All content undergoes the following screening process:
Image Moderation: AWS Rekognition scans all uploaded images for prohibited content (including nudity, weapons, and explicit material).
Text Moderation: Keyword-based filtering of brief submissions and website content.
Manual Review: Flagged content is reviewed by FluxHoster staff within 24 hours.
Zero-Tolerance Enforcement: First violation results in account suspension; second violation results in permanent termination.
No Appeals Process: Decisions regarding prohibited content are final.
7.3 User Responsibility for Content
You are solely responsible for ensuring that all content on your website complies with these Terms and all applicable laws. FluxHoster reserves the right to remove any content and suspend or terminate your account at any time for violations of this policy.
8. Intellectual Property
8.1 User Content Ownership
You retain full ownership of all content you create, upload, or distribute through the Service, including text, images, code, and designs ("User Content"). FluxHoster does not claim ownership of your User Content and does not intend to acquire any rights to your User Content.
8.2 License Grant to FluxHoster
By uploading User Content to the Service, you grant FluxHoster a limited, non-exclusive, worldwide license to:
Host and display your User Content during the term of your subscription.
Create backups and copies of your User Content for redundancy and disaster recovery.
Analyze your User Content for content moderation purposes.
Cache and distribute your User Content via our CDN and third-party services (including GitHub and Cloudflare).
This license terminates upon deletion of your account or content.
8.3 License Grant to Third Parties
By using the Service, you grant:
GitHub: A license to host your website code and assets via GitHub Pages under GitHub’s Terms of Service.
Cloudflare: A license to cache, optimize, and deliver your website content via Cloudflare’s CDN.
AWS: A limited license to analyze images for content moderation via AWS Rekognition (images are not stored by AWS beyond what is necessary for analysis).
8.4 FluxHoster Platform Ownership
FluxHoster owns all rights to the Service platform, including:
Platform code and architecture.
Design and user interface.
Template designs and layouts.
Branding, logos, and trademarks.
Documentation and guides.
You may not resell, redistribute, reverse-engineer, decompile, or modify the FluxHoster platform or any component thereof without written permission.
8.5 Copyright and Trademark
"FluxHoster" and the FluxHoster logo are trademarks of FluxHoster LLC. Unauthorized use of our trademarks is prohibited. All other trademarks and service marks are the property of their respective owners.
8.6 DMCA – Copyright Infringement

Takedown Request Process:
If you believe that content hosted on FluxHoster infringes your copyright, you may submit a DMCA takedown notice to our DMCA agent. Your notice must include:
Your name, address, and contact information.
A description of the copyrighted work you claim has been infringed.
The specific location of the infringing content on FluxHoster.
A statement that you have a good-faith belief that the content is infringing.
Your physical or electronic signature.
A statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Upon receipt of a valid DMCA notice, we will:
Remove or disable access to the infringing content.
Notify the user who posted the content.
Provide the user with a copy of the takedown notice.
Counter-Notification:
If you believe that your content was wrongfully removed due to a DMCA takedown, you may submit a counter-notification. Your counter-notification must include:
Your name, address, and contact information.
A description of the content that was removed and its prior location.
A statement that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification.
Your physical or electronic signature.
A statement under penalty of perjury that the information in the counter-notification is accurate.
Upon receipt of a valid counter-notification, we will restore the content unless the copyright holder files a lawsuit seeking a court order to restrain you from engaging in infringing activity.
Repeat Infringers:
Users who are the subject of multiple valid DMCA takedown notices may have their accounts suspended or terminated at FluxHoster’s sole discretion.
9. Account Termination
9.1 Termination by User
You may terminate your account at any time by logging into your account dashboard or contacting support at [email protected]. Upon termination:
Your subscription will be canceled at the end of the current billing period.
No refund will be issued for the current or remaining subscription period.
Your data will be deleted after a 30-day grace period, subject to our Data Retention policy.
9.2 Termination by FluxHoster
FluxHoster may suspend or terminate your account immediately, without notice, if you:
Violate any provision of these Terms.
Upload or host prohibited content.
Engage in fraudulent, illegal, or abusive behavior.
Fail to pay subscription fees within seven days of a non-payment notice.
Violate copyright or other intellectual property rights.
Harass, abuse, or threaten other users or FluxHoster personnel.
Attempt to exploit, hack, or compromise the Service.
9.3 Data Retention Upon Termination
Upon account termination:
All user data (including account information, briefs, and settings) will be retained for 30 days.
If you wish to recover your account, you may do so by logging in within the 30-day grace period.
After 30 days, all user data will be permanently deleted from FluxHoster servers.
Website repositories on GitHub Pages must be deleted by you; FluxHoster will not delete your GitHub repositories.
Backups of your data may be retained by FluxHoster for up to seven years for tax and legal compliance purposes.
9.4 Effect of Termination
Upon termination of your account:
Your license to use the Service is revoked.
You must immediately cease using the Service.
Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.
Any outstanding fees remain due and payable.
10. Disclaimers
10.1 Service "As Is"
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, representations, or conditions of any kind, either express or implied. To the maximum extent permitted by law, FluxHoster disclaims all warranties, express or implied, including:
Warranties of merchantability, fitness for a particular purpose, or non-infringement.
Warranties regarding the quality, accuracy, or reliability of the Service.
Warranties that the Service will be uninterrupted, error-free, or secure.
Warranties that any defects in the Service will be corrected.
10.2 No Guarantee of Performance
FluxHoster does not guarantee that:
The Service will meet your requirements or expectations.
The Service will be available 24/7 without interruption.
Results obtained from the Service will be accurate or reliable.
Any errors in the Service will be corrected.
10.3 No Liability for User Content
FluxHoster is not responsible for any User Content uploaded, stored, or distributed through the Service. You acknowledge that:
You are solely responsible for all User Content on your website.
FluxHoster does not review User Content for legality or accuracy.
FluxHoster does not endorse or support any User Content.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will FluxHoster, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:
Your access to or use of, or inability to access or use, the Service.
Any conduct or content of any third party on the Service.
Any content obtained from the Service.
Unauthorized access, use, or alteration of your transmissions or content.
In no event will FluxHoster’s total liability for all claims relating to the Service exceed the greater of:
The amount you paid to FluxHoster for the Service in the six months preceding the claim.
One hundred (100) US dollars.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless FluxHoster, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
Your access to or use of the Service.
Your violation of these Terms.
Your violation of any third-party right, including any intellectual property or privacy right.
Any User Content you submit, upload, or otherwise make available through the Service.
13. Third-Party Services
The Service may depend on or integrate with third-party services, including but not limited to GitHub, Cloudflare, Stripe, AWS, and analytics providers. Your use of these third-party services is subject to their respective terms of service and privacy policies.
FluxHoster does not control and is not responsible for third-party services. FluxHoster is not liable for any damages or losses arising from your use of any third-party services in connection with the Service.
14. Privacy and Data Protection
FluxHoster’s collection and use of personal data are described in the FluxHoster Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as set forth in the Privacy Policy.
Key principles include:
Use of encryption (including AES-256-CBC) for sensitive brief data.
Limited data retention aligned with legal and operational needs.
Compliance efforts for applicable privacy laws such as GDPR and CCPA, where relevant.
You are responsible for complying with all applicable data protection laws in relation to your own users, including providing any required notices and obtaining any required consents.
15. Dispute Resolution
15.1 Governing Law
These Terms and any dispute arising out of or related to them or the Service will be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
15.2 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact FluxHoster at [email protected] to attempt to resolve the dispute informally. FluxHoster will attempt to resolve the dispute informally by contacting you via email.
15.3 Arbitration
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration administered by a recognized arbitration provider. The arbitration will be conducted in English, and the seat of arbitration will be in a venue selected by FluxHoster.
You and FluxHoster agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
15.4 Exceptions
You and FluxHoster each retain the right to:
Seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or stop infringement of intellectual property rights or misuse of confidential information.
Bring an individual action in small claims court where permitted by law.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and FluxHoster regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
16.2 Changes to Terms
FluxHoster may modify these Terms at any time. If we make material changes, we will provide you with notice, such as by sending an email, providing a notice through the Service, or updating the "Effective Date" at the top of these Terms. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
16.3 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without FluxHoster’s prior written consent. FluxHoster may assign or transfer these Terms, in whole or in part, without restriction.
16.4 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.
16.5 Waiver
No waiver of any term or condition of these Terms will be deemed a further or continuing waiver of such term or condition or any other term or condition, and FluxHoster’s failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision.
16.6 Force Majeure
FluxHoster will not be liable for any failure or delay in performance resulting from any cause beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor conditions, governmental actions, internet failures, or power outages.
